Who gets the ring when the engagement is off?

PHILADELPHIA (KYW Newsradio) — Paris Hilton is keeping a $2 million engagement ring. Is she allowed to? 

Hilton confirmed last month that she has broken up with her fiance Chris Zylka, but she's keeping the 20-carat, $2 million engagement ring — which is a totally relatable situation. 

Let's say you broke up with your finance and he wants the maybe slightly smaller ring you're wearing back. Who has the legal right to it? 

Actually, it doesn't have anything to do with who broke up with whom, or who has better hair and a hotel fortune. 

A ring given in contemplation of marriage is a conditional gift. The condition is, she gets it if they get married. If they don't get married, she doesn't take title to the ring. 

Hilton said Zylka didn't really give her the ring in the first place — she got it from a celebrity jeweler who gave it to her to get free publicity, so she probably will get to keep it.
