Court ruling allows key public school funding case to move closer to trial

PHILADELPHIA (KYW Newsradio) — A Commonwealth Court ruling Tuesday allows a key school funding case to proceed.  

Commonwealth Court deemed that the lawsuit challenging the equity and adequacy of Pennsylvania's school funding system can go forward to trial.  

The court denied a claim by legislative leaders — including state Senate President Pro Tempore Joe Scarnati and House Speaker Mike Turzai — that the suit was moot because Pennsylvania adopted a so-called fair funding formula two years ago.  

The ruling pleased Education Law Center Legal Director Maura McInerney.

"This eliminates a major obstacle to trial in this case, and is a significant victory for public schoolchildren in Pennsylvania," she said.

No trial date has been set.
